Declaring the triple talaq as unconstitutional in a landmark verdict the Supreme Court today said that triple talaq is “illegal”, “void and against the basic tenets of Quran. Out of five judges bench, three judges of the Supreme Court Justices Kurian Joseph, R F Nariman and U U Lalit by majority asked the government to come out with a law regarding triple talaq and held it as in violation of the Constitution. They also said that any practice including triple talaq which is against the tenets of Quran in unacceptable and the practice of divorce through triple talaq is manifestly arbitrary and violative of the Constitution and must be struck down. On the other hand the duo comprising of the Chief Justice J S Khehar and Justice Nazeer, were of the different opinion from the three other judges and have favoured to keep on hold the practise of triple talaq for six months. They two were of the view that the political parties to set aside their differences and help the Centre in coming out with a legislation.
